Terms of Service & Service Agreement

These Terms of Service (“Terms”) constitute a legally binding agreement between MarshalHost (“MarshalHost,” “we,” “us,” or “our”) and the individual, business, organization, reseller, or other entity purchasing or using our services (“you,” “your,” “customer,” or “client”).
By ordering, activating, accessing, or using any MarshalHost service, you acknowledge that you have read, understood, and agreed to these Terms, together with any applicable service-specific policies, Acceptable Use Policy, Privacy Policy, Refund Policy, and other policies published by MarshalHost.
If you do not agree with these Terms, you must not purchase or use our services.
1. Definitions
For the purposes of these Terms:
“Services” means any hosting, domain, server, email, infrastructure, security, migration, technology, or other service provided by MarshalHost.
“Account” means the customer account used to purchase, manage, or access MarshalHost services.
“Server” means physical or virtual computing infrastructure used to provide a service.
“Website” means any website, application, system, or online content hosted through MarshalHost.
“Content” means all files, databases, applications, media, text, email, data, software, and other information uploaded, stored, transmitted, or made available through your service.
“Reseller” means a customer authorized to purchase and resell eligible MarshalHost services to third parties.
“Billing Cycle” means the recurring period for which a service is purchased.
2. Acceptance of Service Agreement
By creating a MarshalHost account or using any MarshalHost service, you agree to comply with these Terms.
You are responsible for ensuring that all persons who access your account or services comply with these Terms.
If a violation occurs through your account, you may remain responsible for that violation even if another person performed the activity.
MarshalHost reserves the right to update these Terms when necessary. Updated Terms become effective when published through our website or customer portal unless otherwise stated.
Your continued use of our services after an update constitutes acceptance of the revised Terms.
3. Account Registration
You must provide accurate and complete information when creating an account.
This may include:

Full legal name

Business or organization name, where applicable

Valid email address

Telephone number
-
Billing information
-
Address
-
Other information reasonably required for account verification
You must keep your account information current.
Providing false, misleading, incomplete, or intentionally inaccurate information may result in suspension or termination of services.
You are responsible for protecting your account credentials and must immediately notify MarshalHost if you suspect unauthorized access.
MarshalHost will not normally ask for your account password.
4. Service Activation and Delivery
Most services are provisioned electronically after successful payment and completion of any required verification.
Upon activation, relevant service information may be delivered through your registered email address or customer portal.
Service activation time may vary depending on the product.
Certain services, including dedicated servers, VPS, domain registrations, security services, or custom infrastructure, may require additional provisioning or verification time.
MarshalHost will make reasonable efforts to activate services within the expected timeframe communicated during purchase.
5. Customer Responsibility
You are responsible for:

All activity performed through your account

All content stored on your services

Maintaining appropriate backups of important data

Protecting your login credentials
-
Keeping applications and scripts reasonably secure

Maintaining valid domain and contact information
-
Ensuring your use of the service complies with applicable law
MarshalHost is not responsible for loss resulting from your failure to maintain independent backups.
6. Acceptable Use
MarshalHost services may only be used for lawful purposes.
You must not use our infrastructure to:

Conduct illegal activities

Distribute malware
-
Host phishing websites
-
Conduct fraud or scams
-
Launch or facilitate cyberattacks
-
Attempt unauthorized access to systems

Conduct DDoS or denial-of-service attacks
-
Distribute pirated or unlawfully obtained material

Send unsolicited bulk email
-
Operate malicious bots or automated abuse systems
-
Host content that violates applicable law
-
Circumvent security controls
-
Interfere with other customers or network operations
MarshalHost may investigate suspected abuse and take appropriate action where reasonably necessary to protect our infrastructure, customers, third parties, or legal interests.
7. Prohibited Content and Activities
The following activities may result in immediate restriction, suspension, or termination depending on the circumstances:
Security Abuse
Attempting to compromise, scan, exploit, or gain unauthorized access to another system or account.
Malware and Phishing
Hosting or distributing malware, ransomware, phishing pages, credential-stealing systems, or similar malicious content.
Spam
Sending unsolicited commercial email, bulk messages, or operating mailing systems that generate abuse complaints or negatively affect our infrastructure or IP reputation.
Copyright and Intellectual Property Abuse
Hosting or distributing material in violation of applicable copyright, trademark, intellectual-property, or other legal rights.
Fraud
Operating fraudulent stores, payment systems, investment schemes, impersonation services, or other deceptive activities.
Network Abuse
Activities designed to disrupt networks, servers, services, or other users.
8. Shared Hosting Resource Usage
Shared hosting environments are designed to provide resources fairly among multiple customers.
You must not use shared hosting in a manner that significantly affects server stability, performance, or other customers.
Examples of potentially excessive use include:

Sustained excessive CPU consumption

Excessive memory usage
-
Abnormally high disk I/O
-
Excessive database activity
-
Large-scale automated processing
-
Resource-intensive background processes
-
Unreasonable email activity
-
Running applications unsuitable for shared hosting
If your account creates a significant operational impact, MarshalHost may contact you and request optimization, migration to a more suitable service, or reduction of resource consumption.
Where immediate action is required to protect the server or other customers, temporary restrictions may be applied without prior notice.
9. Backups
MarshalHost may provide backup services depending on the hosting package.
Backups are intended as a recovery facility and should not be considered a substitute for maintaining your own independent backups.
MarshalHost does not guarantee that every file, database, email, configuration, or account state will always be recoverable from backup.
Customers are strongly encouraged to maintain independent copies of important business and personal data.
Backup retention and restoration availability may vary by service.
Any applicable restoration charges will be communicated through the relevant service or support channel.
10. VPS Services
VPS customers are responsible for software, applications, configurations, and activities performed within their virtual server unless a specific managed service states otherwise.
Customers must not:

Deliberately overload the host infrastructure

Run malicious processes
-
Conduct network attacks
-
Operate prohibited services
-
Attempt to compromise the host node

Abuse network resources
-
Use the VPS for activities prohibited under these Terms
Where a VPS creates a serious threat to infrastructure or other customers, MarshalHost may temporarily suspend or restrict the affected VPS.
11. Dedicated Servers
Dedicated servers provide greater control and resources than shared environments.
Customers remain responsible for the applications, operating systems, configurations, and content they operate unless management services are explicitly included.
Dedicated server customers must comply with all applicable laws, network policies, and MarshalHost Terms.
Dedicated server services may have different cancellation, billing, provisioning, and SLA conditions depending on the selected configuration.
12. Domains
Domain registrations and transfers are subject to the rules and policies of the applicable domain registry, registrar, and governing authority.
Domain fees are generally separate from hosting fees.
Once a domain has been successfully registered, certain domain-related charges may be non-refundable because registration fees are paid to third-party registries or registrars.
Customers are responsible for:

Providing accurate registrant information

Keeping contact information updated

Responding to domain verification requests
-
Renewing domains before expiration
-
Complying with applicable registry policies
MarshalHost cannot guarantee that a particular domain name will remain available until payment and successful registration are completed.
13. Free Domain Offers
Where a hosting plan includes a promotional free domain, the offer is subject to the conditions displayed at the time of purchase.
